vQuip, Inc. and its affiliated companies (including vQuip Insurance Agency, LLC, collectively, “vQuip,” “we,” or “us,”) maintains and operates https://www.vquipsolutions.com/ and related websites, including all services and products made available through vQuip’s sites (collectively, the “Website”), together with vQuip’s proprietary booking and risk management platform and related products or services made available through the platform (collectively, the “Platform”). Together, the Website and the Platform are referred to in this Privacy Policy as the “Solutions.” “You” or “your” refers to the person accessing the Solutions. You may be a “Platform User” if your employer has purchased access to the Platform on your behalf. Otherwise, you are an “End User” if you use or interact with the Solutions in your personal capacity.

This Privacy Policy describes the types of personal information you may provide us or that we otherwise or collect or receive in connection with your use of the Solutions. This Privacy Policy also describes how we use, disclose, and otherwise process your personal information. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not download, register with, or use the Solutions. By downloading, registering with, or using the Solutions, you consent to all actions taken in accordance with this Privacy Policy. This Privacy Policy may change from time to time. About vQuip

vQuip provides the Platform to employers, marinas, and other companies that operate boat rental facilities (collectively, “Commercial Customers”). In addition to providing the Platform to Commercial Customers, vQuip provides risk management services and rental booking services to its Commercial Customers. As part of this arrangement, End Users may schedule and purchase boat rentals and other services provided by Commercial Customers directly through vQuip. In some cases, End Users may also purchase boat rental insurance from vQuip through the Solutions in connection with the End User’s boat rental from a Commercial Customer. All services provided by vQuip to Commercial Customers constitute “vQuip Services.” When an End User operates a boat rented from a Commercial Customer or otherwise interacts with the applicable Commercial Customer’s systems and technology, information about the End User and its use of the Commercial Customer’s boats, systems, and equipment may be transmitted and stored in the Platform (such information, whether personally identifiable or not, “Usage Data”). For example, if a Commercial Customer uses a third-party GPS system on one of its rental boats, the GPS system may integrate with the Commercial Customer’s instance of the vQuip Platform, and vQuip may receive boat speed, position, and location data from the third-party GPS system.

When vQuip receives Usage Data about an End User or generated by an End User’s operation of a Commercial Customer’s or third party’s systems, equipment, or technology, vQuip will use, store, disclose, and process any personal information contained within the Usage Data in accordance with the provisions of this Privacy Policy. However, each Commercial Customer’s use of the End User’s Usage Data and personal information is subject to the Commercial Customer’s own privacy policy. In addition, while Usage Data may be transmitted to vQuip from third-party devices, systems, and technology, the applicable third party’s use, disclosure, and processing of each End User’s personal information is subject to the applicable third party’s own privacy policy. Similarly, the Website may provide links to third-party sites, services, or products. This Privacy Policy does not apply to your use of third-party sites, services, or products, and we encourage you to read the applicable third party’s privacy policy before you interact with third-party resources.
How We Obtain Your Information

Collection Overview.

We collect your information:

  • (1) when you voluntarily provide it to us,
  • (2) through the use of automatic tracking technologies,
  • (3) through your use of third-party products or services that transmit or store data within the Platform; and (4) from our Commercial Customers, if you have purchased products or services for which vQuip provides vQuip Services to the applicable Commercial Customer.

Information You Provide.

When you register with or use the Solutions, we may ask you to provide the following information: name, email address, residential and/or billing address, phone number, job title (if you are a Platform User), employer (if you are a Platform User), payment information (if you are an End User purchasing products or services via the Solutions), driver’s license or boating license number or status (if you are an End User purchasing products or services via the Solutions), date of birth, and the name and contact information of another person that you would like to list as your emergency contact. You may also provide additional, optional information when filling out forms, contact requests, or support requests through the Solutions.

Information you voluntarily provide also includes records and copies of your correspondence with us, your responses to surveys and questionnaires that we might ask you to complete for research purposes, details of transactions you carry out through the Solutions and the fulfillment of your orders, and your search queries on the Website.

Automatic Collection.

When you download, access, or use the Solutions, it may use technology to automatically collect information about you, your device, and your activities on the Solutions. When you access and use the Solutions, we may automatically collect certain details of your access to and use of the Solutions, including traffic data, location data, logs, communication data and the resources that you access and use on or through the Solutions. We may also collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information, and the device’s telephone number. The Solutions may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information. If you do not want us to collect the information described in this paragraph, do not use the Solutions.

Tracking Technologies.

The technologies we use for automatic information collection may include cookies (or mobile cookies). A cookie is a small file placed on your computer or smartphone. It may be possible to refuse to accept mobile cookies by activating the appropriate setting on your device or smartphone. However, if you select this setting you may be unable to access certain parts of our Solutions. The Solutions and our emails may also contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel

gifs) that permit vQuip, for example, to count users who have visited certain pages or opened an email and for other related statistics (for example, recording the popularity of certain content made available via the Solutions and for verifying system and server integrity).

Commercial Customers.

As described in About vQuip above, we also receive information and Usage Data about you from our Commercial Customers and third parties with whom you interact in the course of operating products and services from our Commercial Customers.

Third-Party Collection.

When you use the Solutions or any content made available on the Solutions, certain third parties may use automatic information collection technologies to collect information about you or your device. These third parties may include advertisers, ad networks, ad servers, analytics companies, your mobile device manufacturer, and/or your mobile service provider. These third parties may use tracking technologies to collect information about you when you use the Solutions. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites, apps, and other online services websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • 1. Provide you with the Solutions and its contents, and any other information, products, or services that you request from us (including, for example, providing you with boat rental insurance that you have purchased from us).
  • 2. Fulfill any other purpose for which you provide it (including, for example, responding to customer support inquiries submitted via the Website).
  • 3. Give you notices about your account, including expiration and renewal notices.
  • 4. Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • 5. Carry out our obligations and enforce our rights arising from any contracts entered into between us and our Commercial Customer from whom you have purchased products or services.
  • 6. Notify you when updates are available, and of changes to any products or services we offer or provide though the Solutions.
  • 7. Research, develop, improve, and market our products, services, and insurance offerings.
  • 8. Help maintain the safety, security, and integrity of the Services, databases, and other technology assets, and business.
  • 9. Estimate our audience size and usage patterns on the Solutions.
  • 10. Store information about your preferences, allowing us to customize our Solutions according to your individual interests.
  • 11. Speed up your searches and recognize you when you use the Solutions.
  • 12. We may also use your information to contact you about goods and services that may be of interest to you. If you do not want us to use your information in this way, you can unsubscribe from marketing emails from within the email itself.

As a reminder, our Commercial Customers and other third parties that collect your information (whether they disclose your information to vQuip or not) have their own privacy policies and may use your information for other purposes.

Disclosing Your Personal Information

We may disclose aggregated information about End Users and Platform Users, and information that does not identify any individual, without restriction. In addition, we may disclose personal information and Usage Data to:

  • 1. To our subsidiaries and affiliates.
  • 2. To contractors, service providers, and other third parties we use to support our business.
  • 3. To current and prospective insurance underwriters, policy managers, claims agents, and other service providers that provide and administer the rental insurance policies vQuip makes available to End Users.
  • 4. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of vQuip’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by vQuip about our Solutions users is among the assets transferred.
  • 5. To a payment processor.
  • 6. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of vQuip, our Commercial Customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
  • 7. To our Commercial Customers.

  • 9. To fulfill the purpose for which you provide it.

Security

We work to protect your personal information from loss, misuse, or unauthorized alteration by using commercially reasonable security safeguards, coupled with security procedures and practices. Although vQuip employs measures to maintain security, we cannot guarantee that your information will not be intercepted or misused by third parties. It is your responsibility to maintain the privacy of your username and password. Unauthorized use of your registered account with us will enable access to your personal information.
